The non-pecuniary damages for mental disorders is excluded only when it derives from carrying work performance in polluted environment , as must be also supported by the seriousness of from any psycho-physical injuries of the subject and the causal link between the subjective and the event was damaging.
The Supreme Court has thus complied with the orientation expressed in the joint sections (Case No 2515 of 21.2.2002), as in this case has been proved only in relation to the performance of work under the 'exposure to pathogens (asbestos) without offering it, even indirectly, on external facts (insomnia, poor appetite, illness psycho-somatic, behavioral disorders, etc.)..
