D.Lgs 06.02.2007 n° 25 Informazione e consultazione dei lavoratori
With the Legislative Decree 06.02.2007 N. 25 , implementing the Directive 2002/14/EC , are introducing a general system for informing and consulting firms in lvoratori occupying a minimum of 50 employees.
It sets out a detailed schedule of time and content for the concrete implementation of a system integration company -workers in order to assess the development of the business, its financial situation and structural as well as, more generally, in respect of any decision that is likely to lead to major changes in work organization and labor contracts with a potential occupational hazards.
Legislative Decree prevede, altresì, la costituzione da parte dei contratti collettivi di una commissione di conciliazione per le contestazioni concernenti le informazioni, sia per ciò che riguarda la loro eventuale natura riservata, sia in ordine al danno che potrebbe derivare all'impresa interessata dall'eventuale divulgazione delle stesse.

Inoltre, l' art. 21, d.lgs. n. 165 del 2001 offre la facoltà del recesso dal rapporto con il dirigente pubblico, con riferimento al rapporto fondamentale, solo a fronte delle mancanze più gravi (rilevate con le garanzie di cui al d.lgs. n. 286 del 1999 e ferma restando l’eventuale responsabilità disciplinare ricavabile dal contratto collettivo), prevedendo, negli altri casi, l'impossibilità del rinnovo dell'incarico di funzione oppure il suo collocamento a disposizione in leadership roles in art. 23, Leg., Cit. , saving thus the fundamental relationship, even in deference to the traditional stability of employment for civil servants.
This excludes the applicability of the principle of freedom to recedibilità nutum (art. 2118 cc) -employment of the public official (the principle that remains, therefore, confined nell'alveo of private relationships).

So decided the Supreme Court set aside the ruling of Judge of Appeal, which, varying the decision of first instance (which had recognized the real protection to the officer unlawfully dismissed for delay in sending the termination of the agreement prior to the test ' office), it had recognized the proper compensation to the manager (only from the date of dismissal up on the completion of function) but had ruled out its reintegration into the workplace, based on the ground that this was excluded from the provisions of 'Art. 10, L. No 604 of 1966, thus limiting the scope of operation of real protection.
