Consequently, with regard to the underlying relationship - which in this case had two-year term -, given its equivalence to that of the white collar category (Article 21, law no., Cit.) the employer must be ordered to pay damages consisting in the payment of wages from the date of dismissal to the expiration of the contract .
So decided the Supreme Court set aside the ruling of Judge of Appeal, which, varying the decision of first instance (which had recognized the real protection to the officer unlawfully dismissed for delay in sending the termination of the agreement prior to the test ' office), it had recognized the proper compensation to the manager (only from the date of dismissal up on the completion of function) but had ruled out its reintegration into the workplace, based on the ground that this was excluded from the provisions of 'Art. 10, L. No 604 of 1966, thus limiting the scope of operation of real protection.
